Terms of Service

These Terms of Service ("Terms") govern your use of www.jarretthome.com (the "Site") and the sale of products by RM ECOM, trading as Jarrett Home ("we", "us", "our"), to you ("you"). By placing an order, you accept these Terms. Please read them before ordering.

1. Who you are buying from

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract. By ordering, you confirm that you are.

3. Products

We describe our products as accurately as we can. Photographs and videos are illustrative: colors vary between screens, and accessories are only included where the description says so. Dimensions and weights are approximate and subject to normal manufacturing tolerance.

Our products are consumer goods for household use. They are not medical devices, and nothing on the Site is medical advice. Where a product relates to health, safety, or security, it is an aid and not a guarantee — read the product page and the instructions supplied with it.

4. Prices and taxes

Prices are shown in U.S. dollars and include all applicable import duties.
Sales tax, where it applies, is calculated and shown at checkout before you pay.
Shipping is free on all orders.
We may change prices at any time, but the price that applies to your order is the one displayed when you place it.
If a product is listed at an obviously incorrect price because of a technical or human error, we may cancel the order and refund you in full. We will tell you before we do.

5. Orders

Your order is an offer to buy. The contract is formed when we send you a shipping confirmation, not when you receive the order confirmation.

We may refuse or cancel an order where the product is unavailable, payment is not authorized, we suspect fraud or resale, the delivery address is outside the area we serve, or a pricing error has occurred. If we cancel after you have paid, we refund you in full.

6. Payment

Payment is taken at checkout through our payment providers. You confirm that you are authorized to use the payment method you provide.

7. Delivery

Delivery terms are set out in our Shipping Policy, which forms part of these Terms. Risk of loss passes to you on delivery.

8. Returns and refunds

Your return rights are set out in our Refund & Return Policy, which forms part of these Terms. In summary: 30 days from delivery, item unused and in original condition, Return Authorization number required, return shipping paid by you except where the item is faulty, damaged, or not as described.

9. Warranty

We warrant that products will be free from defects in materials and workmanship, and will match their description, for 12 months from delivery. If a product fails within that period through no fault of your own, contact us and we will repair it, replace it, or refund you, at no cost to you.

This warranty does not cover normal wear, accidental damage, misuse, unauthorized modification, or failure to follow the supplied instructions.

10. Disclaimer of other warranties

EXCEPT FOR THE LIMITED WARRANTY IN SECTION 9, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PRODUCTS AND THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Some states do not allow the exclusion of implied warranties, so this exclusion may not apply to you. Nothing in these Terms limits your rights under mandatory consumer protection law in your state of residence.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SITE OR THE PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law.

12. Your use of the Site

You agree not to use the Site unlawfully, to interfere with its operation, to scrape or copy it systematically, or to attempt unauthorized access. We may suspend access if you do.

13. Reviews and content you submit

If you submit a review, photo, or comment, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display it in connection with Jarrett Home, including in our marketing. You confirm the content is yours, is truthful, and does not infringe anyone's rights. We may decline to publish or may remove content, but we do not edit reviews to change their meaning, and we publish negative reviews alongside positive ones.

14. Intellectual property

The Site and its content — including the Jarrett Home name, logo, text, images, and layout — belong to us or our licensors. You may not use them without our written consent.

15. Marketing messages

We send marketing emails and texts only to people who have opted in. If you consent to text messages, message and data rates may apply. Reply STOP to any text to unsubscribe, or HELP for help. Unsubscribe links appear in every marketing email. Order and shipping notifications are transactional and continue regardless.

16. Third-party links

The Site may link to third-party websites. We do not control them and are not responsible for their content or practices.

17. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including carrier failure, customs action, natural events, or interruption of essential services.

18. Governing law and disputes

These Terms are governed by French law. However, if you are a consumer resident in the United States, you keep the benefit of any mandatory consumer protection rules of your state of residence, and nothing in these Terms deprives you of them.

Before starting any formal proceeding, please contact us at support@jarretthome.com. We resolve almost every problem this way, usually within a few days.

19. Severability and entire agreement

If any provision of these Terms is held unenforceable, the rest remain in force. These Terms, together with our Shipping Policy, Refund & Return Policy, and Privacy Policy, are the entire agreement between us regarding your order.

20. Changes

We may update these Terms. The version that applies to your order is the one published when you placed it.
